Your Immigration Questions Answered
1. Which visa should I apply for?
This depends on your reason for staying in South Africa; work, business, study, family, or asylum. We offer consultations to assess your status and help you choose the correct visa category based on your personal and professional circumstances.
2. Can I apply for permanent residence in South Africa?
Yes, but you must meet specific criteria. Common routes include:
- Living in SA as a refugee for 5+ years (Section 27)
- Marriage or life partnership with a South African citizen
- Employment under a work visa for 5+ years
- Significant business investment or critical skills
3. I’m an asylum seeker. Can I apply for permanent residence?
If you’ve held refugee status for five consecutive years, you may qualify for permanent residence under the Refugees Act. We can help determine your eligibility and prepare a strong application.
4. What is a visa waiver, and when do I need one?
A waiver is special permission to bypass certain visa requirements, like the R5 million capital requirement for a business visa. If you don’t meet all standard criteria, we can apply for a waiver on your behalf.
5. What documents do I need to apply for a visa?
Requirements vary by visa type, but generally include:
- Valid passport
- Proof of purpose (e.g. work contract, marriage certificate)
- Police clearance certificate
- Proof of financial means
- Medical and radiological reports
- Application forms and fees
We’ll provide a personalised checklist after your consultation.
6. Can I work in South Africa with a visitor’s visa?
No. A visitor’s visa under section 11(1) does not permit employment, unless work authorisation is endorsed. This is applicable only for short-term work.
7. What happens if I overstay my visa?
Overstaying may result in:
- A re-entry ban (1–5 years)
- Deportation
- Undesirable status
- Future visa complications
If this applies to you, contact us urgently to explore legal remedies.
8. Can I register a business in South Africa as a foreign national?
Yes. Foreign nationals can register a company through CIPC, but running the business legally requires a valid business visa. We assist with both business registration and immigration compliance.
9. Do I need a lawyer to apply for a visa?
Not necessarily. But South African immigration law is detailed and strict, and minor errors can cause major delays or rejections. Cream Legal helps you apply correctly the first time, reducing legal and financial risks.
10. How long does it take to get a visa or permanent approved?
Average processing times:
- Temporary residence visas: 4–12 weeks
- Permanent residence: 6–12 months or longer
Delays vary depending on visa category, nationality, and Home Affairs backlog. We help manage your application timeline and follow-ups.
